I just got fined by a cop General Duties for speeding 15kms or over I said no way and asked for a readout, he said no, I said what am i getting fined for he said Estimated 15kms over, I said no way, Can I get away with this in court.? someonestolecc Posted August 5, 2004 Share Posted August 5, 2004 SuperGimp - The NSW Ombudsman's report I was reading there is an estimate thing where they are allowed to estimate your speed and give you a ticket. In court it would come down to your barrister, is that worth it? I don't know. It would help if it's your first offense and the copper hasn't given out many tickets etc. But you know how courts can go. "This officer of 15 years has successfully issued over 2000 speeding infringement notices. He is highly decorated in local donkey porn and has blah blah blah". OR "This officer of 5 weeks has issued only 3 traffic infringements and this is his first ticket. He has not received his training nor is he a highway patrol qualified officer, my client has never received a ticket...." blah blah blah. As you can see.. For 2 points or whatever it is is it really worth it? Good luck either way tho. GTR R35 Posted August 6, 2004 Share Posted August 6, 2004 If he was in a general duties car, you have a good chance of getting off. If he was by himself, you have got a Great chance of getting off. I have been done twice for speeding, both by GD police and got off both times in court. Make sure you write everything down. I have even filled out the court election in front of the cop 5seconds after she gave it to me !!! The magistrate will look at your driving record and the cops experience. If it is your word against his and he has no traffic experience, you will get off. It is worth the effort for 4 hours in your day. They will give you the cops statement and your driving record before you go into court, so you can highlight the inaccuracies in his statement and shoot holes in his statement. Cops only make a couple of lines of notes after they write you out a ticket, so they tend to forget the details after 6 months when it comes to the court apperance.
