all i saw about the silvia was that it was speeding so does this mean if we are speeding they can impound our car?

if im going like 10 over the limit can they say that because of my car and my age im a hoon?

it seems to me that they hav left this 'hoon' thing very open and general so they can pretty much do as they please

isnt that what speeding fines are for?.... if he got his car taken for speeding does that mean he doesnt get a speeding fine or loose his license? (anything over 60kph over the posted speed limit isnt it?).... or do we now get a fine, lose our license and get our rides taken!!

I think it's fair to say that everyone owning Jap imports will be well aware of this new law even if it's only of it's implementation and it's fair to say that the idiot that BOO5T mentioned in the champagne Silvia would have been aware also. Considering the severity of the offense, I think it's fair to say that he just doesn't give a shit about the law and worse still, has no regard for human life. If I were the authorities I would be bypassing the first 2 stages and just implementing the third stage. But then that's just me having less tollerance than the authorities for the mindless acts of hoons.

If you read what's involved in the entire process you might realise that it's not going to make bugger all for the govt. especially when it involves so few people.

The Minister said there had been 60 deaths over the last 12 months which were related to dangerous and reckless driving. Seven of those deaths occurred in a six-week period.

"In one incident, the two young occupants of a car were travelling at more than 160kmh down a freeway before the driver lost control and crashed into an embankment," she said.

Mrs Roberts said there were hundreds of drivers throughout the metropolitan area who regularly terrorised their local communities through street racing, doing 'burnouts' and conducting time trials.

"It is common knowledge that hoons are dearly attached to their cars or motorbikes, but if they continue to use the roads like a racetrack, then police will confiscate the possessions they value so greatly," she said.

The Minister said some of the offences for which vehicles could be impounded included:

doing a burnout; or as a result of dangerous or reckless driving;

racing another vehicle; and

speeding, accelerating or braking and skidding wildly.

Mrs Roberts said combating speeding drivers was a major factor in drafting the new laws.

"During the 'double demerits' long weekends (42 days) in 2002-03, police detected more than 100 people speeding at more than 45kmh over the limit," she said.

"The most excessive speed was nearly 100kmh over the legal limit and the highest was 122kmh in a 50kmh zone."

Under the new laws:

people caught racing their cars or doing burnouts will have their vehicles seized and impounded for up to 48 hours;

if a second offence occurs, the car will be impounded for up to three months and the driver's licence could be suspended;

if there is a third offence, the vehicle will be forfeited and the driver's licence could be cancelled; and

drivers caught travelling 45kmh or more above the legal limit also risk having their licences cancelled.

It's fair to say that anything under 45km/h over the limit will just come under the standard fine/demerit points system, unless of course reckless or dangerous driving is also involved.

the other highlighted item gives you an idea why this law was brought in. I don't think it was a petty thing

ric777, I agree with many of your points, and pretty much 95 percent of your posts. Nice to see someone writing well thought out posts on here (for a change).

Anyway the points I would like to make are as follows:

1. The definition of the law which you state is fairly clear has ambiguous wording; "accelerating or braking and skidding wildly". By this definition a car isnt permitted to accelerate or brake. An open ended definition like this is bound to be interpreted by many traffic officers differently, and therefore applied in an incosistent manner. Having had contact on a WA motorcycle forum list in the past few days, the riders who are officers on there have stated they know very little about the law or how it is meant to be applied in many instances. So the government which has been letting driver training down for years is also letting police training down too?

I think we just all have fears that this legislation will be applied in an inconsistent and unfair manner.

2. The Silvia driver who lost his car the other night was also done for drunk driving. If there is anyone on this forum who denies that this idiot deserved to lose his car, then please turn yourselves in to your local police station for a free bullet in the head.

3. From a personal perspective, I try my damndest not to speed probably 99 percent of my time on the road, resulting in me having no fines in nearly 3 years now (back to 12 points in November). However I tend to regularly gun it up to the speed limit down on ramps, occasionally from the lights etc. Things we ALL engage in, just to feel that rush of boost from time to time, most times without even losing traction in the slightest. I have grave fears that police targeting people "accelerating" now, not just "speeding" will result in people being labelled hoons without reason. How would you feel losing your car for 48 hours without breaking the speed limit?

4. I think we all need to give this law some time to see its effect. Ive no doubt it can be something truly positive for WA's roads if implemented and enforced with proper care. However we have all had an experience once or twice with a totally unreasonable traffic cop, which leads us to suggest, it wont be positive at all.

5. We've all lived with the threat of losing our licence for driving 45km/h+ over the speed limit before. Dont really know why people are making a big deal out of it now. Afterall what possible reason do you have for doing such a stupendous speed on the road?

6. Learn from mistakes people. Getting caught for doing 39km/h over the limit a month after an accident is just plain silly. Having had 2 accidents already (1 of which was my fault) ive learnt to treat every single driver on the road as a total idiot, capable of doing anything at anytime.

7. Get more involved in weekend motorsport. Easiest way to get a speed fix :)

Also, i think that perth is lacking the places for people to take it to the track. We have the motorplex which is great, but im sure alot of people would like to see something for once a week or once every 2 weeks.

Alot of the younger drivers also are into drift (i am for sure) and perth has no place really where we can go fang it out for a night a week, i think if they built a purpose built drift track someone where too not far (possible near motorplex or airport area) and had it once a week alot of drivers would pay to go for a drift :)

I've been driving for over 10 years now, and the only time I have ever been done for over 45km/hr was when I was 17 in my dad's car, so I'm not sure how these laws prevent stupidity on the road. I think they should be encouraging driver training. No where do they demand that these hoons preform any form of community service etc. I expect these laws to have very little effect other than to encourage people to run if chased by police.

I encourage all Skyline owners to take there aggression out at the motorplex, or race track, and SAUWA will be actively trying to get involved in alot more events. Our first driver training session is on the 11th of Sept., and we hope to provide many more opportunites to have a fun time with there cars in a safe environment.

I'll give you an example. Some dickheads up the road have on a number of occasions come boring down the road and slammed on their brakes right in front of my place to turn onto the street opposite me. They left quite a long skid mark on the road. On the last occasion that they did it I was out the front and picked up a piece of wood I had handy and threw it at them. I missed them as I don't throw too good, but they saw it and haven't done it again.

Your example is not a very good one.

Yes, that would be a good idea.

It's leaving it up to police to make a judgement that is more of a worry. There are currently no guidelines provided to them on how to make a decision on this new law, and depending on who you get they may make a different decision.

They are able to confiscate our vehicles without going to a court to make a decision, and this to me is worrying:(

they bought in that whole taking your car off you thing in sydney ages ago for doing burnouts or street racing... people kept getting their cars back by going to court so now i dont think they do it anymore... NSW law says that to be considered a burnout the wheels need to be smoking for more than 8 seconds... coz u cant exactly call chirping 2nd gear a burnout... im sure cops here will use the new laws to flex their authority muscles...

to avoid it all i suppose just dont drive like a dickhead... let them bust all the bogans in falcadores...

MY OPINION!

Years ago in one of my V8's I had, the exhaust system was a little noisy when accelerating hard. I took off from the lights rapidly but hadn't gone over the speed limit. At the time I was a smart ass and thought that because I wasn't going over the speed limit I couldn't get booked for anything. I was unaware of the excessive noise law. Consequently I did it once too often and was stopped and booked for undue noise and copped a yellow postage stamp as well. I guess that would be an example of excessive acceleration. I'd say a noisy exhaust is always going to attract attention.

The braking, well I've mentioned that b/4. I might add that my series 1 "line" has ABS so screaching my brakes is not going to happen.

Judging by the law as mentioned previously, the speeding side of things will be cut and dried. The proof will be unquestionable, radar readouts, multanovas. As for the other infringments, the judge will be the decider and executioner and I would say that if the offender pleads not guilty, things like past record will come into it.

My cousin has mentioned that he knows of a couple of cops that had their cases thrown out in the past because of lack of evidence. I'm sure that the judge will be well aware that some cops will be out to screw people and that's where past records will also help him make a judgement.

I might also add as I've mentioned b/4 in the other thread, that the likes of dangerous and careless driving has for a long time been a charge laid by the individual cops. Some abused their authority and some didn't. The stakes are a bit higher now so it's really up to us to keep our noses clean and perhaps the club could go public and distance itself from dickheads like the Silvia driver.

Yes I understand and I would say not to get too hung up on that one. Most cops will be looking out for racers and trouble makers. The bad cop will take any opportunity to make life hell, there's not much we can do about that except fight him in court. The club should voice it's concerns about any grey areas that might exist in the law. I personally don't see any and it is only the bad cop issue that I think we would all agree on.

Bent cops have framed people for murder, a far more serious accusation. How do we stop that, then ?
