The Minister said there had been 60 deaths over the last 12 months which were related to dangerous and reckless driving. Seven of those deaths occurred in a six-week period.

"In one incident, the two young occupants of a car were travelling at more than 160kmh down a freeway before the driver lost control and crashed into an embankment," she said.

The Minister said some of the offences for which vehicles could be impounded included:

doing a burnout; or as a result of dangerous or reckless driving;

racing another vehicle; and

speeding, accelerating or braking and skidding wildly.

Mrs Roberts said combating speeding drivers was a major factor in drafting the new laws.

Is it that hard to understand what hooning is?? Defines it quite clearly I would think

Under the new laws:

people caught racing their cars or doing burnouts will have their vehicles seized and impounded for up to 48 hours;

if a second offence occurs, the car will be impounded for up to three months and the driver's licence could be suspended;

if there is a third offence, the vehicle will be forfeited and the driver's licence could be cancelled; and

drivers caught travelling 45kmh or more above the legal limit also risk having their licences cancelled.

Can not see what the problem is. Most people with half a brain would wake up after the first warning, which is a fair warning I would reckon. Judging by the reaction on this thread, it would seem that some peoples toes are being stepped on.

Got stopped last Sunday doing 18 over the limit. They booked me for 16 over. The sheila cop did the booking and the male cop looked over the car and said "nice car". Judging by some of the comments on this thread, I'd say that half your problem when you get stopped is attitude. Can hardly blame a cop for getting ferral.

In your post you have admitted to speeding. Yes it was only a small amount and the cops where civil i'm guessing.

The point some people are making is that it is not very quantifiable. It the cops were not civil , how would you feel if your speeding was deemed as strike 1?

Personally I'm all for driver training and lower road tolls, but lets find a better solution than one policemans (or woman) opinion who may be having a bad day

im more comcerned about how they enforce this law, its basicly up to the discression of the cop if they impound your car.... so if im flying down the freeway doing 45km over the limit in my misses stock n13 pulsar, will they impound the pulsar? i doubt it but if im doing the same in my skyline (which i obviously wouldnt ) or someone in a v8 commodore.. im sure they will....

plus what if you want to contest your charge, when do they impound your car, once you have been found guilty or on the night of the charge?

if they implemented these laws in Victoria, I don’t think I’d give handover my car without a fight…either I would either drive away from the police in my car and start a chase, or start a fight with the actual police (assault) but f*ck if I’m letting them take my car and the money it is worth, its like they are getting money for free “again” and I guess they would auction it off???

bullseye Scott, What if a regular skyline/commodore/other high powered car driver happens to step into his friend/gf/parent's cruddy/slow car and steps harder cos it aint getting anywhere (compared to his original beef), is that car gonna get impounded? no.

Police need to be more consistent with their infringements. Eg a nice cop that says "nice car" vs a crap cop that gives u a first warning for releasing the clutch too quick on a wet day.

In another thread on the same subject I stated that back in the days of the Shakers, Monaros XU1's etc, there were bent cops and there was the odd case of a cop wrongfully booking a "hoon". Nothing has changed and it's up to the individuals to make sure the cops have no reason to pick on them. If you suggest that there isn't a problem with hoons then it's going to be difficult getting your head around these laws. That Leach Highway incident cost 2 lives, just because of some "hoon" and that's not an isolated incident.

The differences we have now compared to the old days is the ****tail of drugs that are available now and the amount of people using them while driving is quite frankly very disturbing. Add to that the amount of alchohol used per capita now and cars that are so much faster, throw in some mindless hoons and it's not surprising that we have disasters occurring and consequently new laws.

If the potential exists that a bent cop can exploit these laws and many people are concerned, then I'd suggest that SAU, as a club, should lobby the Govt. to put some safeguards in place. The members themselves need to set an example so that the cops will have some kind of respect for SAU people. But I get a little concerned when I read some of the comments in this thread and anyone from the outside reading these comments would probably feel the same. I've always said that the ones who make the most noise are usually the ones that these types of laws will affect.

I really think that some of the SAU members need to put aside their selfish attitude and think about the people that have lost a family member to hoons.

IM still abit confused about the 3rd time, i dont see how the government/police can just take away a car that you pay for , for some reason it doesnt seam legal to me, also wat happens if you are not the owner of the car you just happen to be hooning in it, can they still do the following things to the car?

What if it’s not my vehicle?

The owner of the vehicle will be notified by Police.

The driver is responsible for the towage, storage and other relevant costs incurred in impounding the vehicle if found convicted of the offence.

If the car has not been collected by the time the impoundment period expires (48 hours), the owner is responsible for post-impoundment fees.

Can it get worse than 48 hours impoundment?

Yes.

If you are convicted of a second impounding offence within three years of the first, the court may impound the vehicle for up to 3 months.

Basically. they don't give a f&ck who owns the vehicle. Best case for the 3rd offense is your friend lent you the car to you and they impound it for 6mths. If it's in your parents name, it gets confiscated unless you can prove they lent it to you. ie, it's the family car and not your own runabout. I can see this one getting contested at the courts a lot.

I havent lost a family member to a 'hoon' but I have lost sleep on friday/ sat nights listening to tossers smoking it up down local streets. mainly v8's I have to say.

There IS definately a problem to be addressed with irresponsible driving and the situation has been getting steadily worse with the increase of modified cars etc. people have always been dying on the roads but I think its the nuisance factor that has resulted in action being taken, as its just plain annoying for the general population to have to put up with the noise and aggression on display everywhere you go. I farken hate it myself and don't blame them for trying to do something about it as we all live closer together and the roads are getting busier all the time so tension levels are climbing. mine are anyway.

Every second car has an aftermarket exhaust these days and its just not cool anymore. If you were giving it a bit of stick on back roads at night in a quiet car, I bet no one would even notice.

BUT, I dont want to be painted with the same brush because my car looks like the usual suspect. So.. I hope they go by actions and not appearances. To sum it up - as usual some WANKERS have inevitably ruined it for all of us!

The issue here is not so much speeding..........

It's more reckless people doing burnouts, jumping on the sidewalk killing pedestrians and it’s in the response to letting alcoholics back on the roads so the entire design about this law is motivated by money……..exploiting peoples situational factors that are not always controlled……………….Speed is not one of them………………………………..

There are number of avenues to exhaust in fighting a problem that is hooning.

But does the government want to spend money? They make their civil duty as it is a war against terrorism. Not exactly the same is it? Well, unless you terrorise old people in the car park of the shopping mall or you are the prison escapee than cops should take your car away from you.

It’s all about making money.

To get your car back: You will need to go through more training and pay for a temp driver probation licence that will scar your record. And lets not talk about insurance later.

They will charge their fee for your indiscretion. So the cycle goes on. You will have to take the car through the pits again ……bla bla bla bla………..and report back in few months to do a test. Than you will have to pay for the test and get the sticker taken of your licence……..as in some states in the US.
