Happened to me a few years ago.

Got the letter in the mail about 2 weeks later telling me 1 would loose license for 12 months, took em to court which took another 8 months and they changed their 'guesstamation' and let me off with a lesser loss.

I was speeding and I and they knew it, but they couldnt prove exactly how fast I was going.

Was there only 1 cop in the car? If so it will be easier to argue in court with, I had 2 cops, 1 being a senior sargent so even if he made up all lies (90% of what he said was in my case) the judge will believe them over u.

120km/h with $210 fine and 3 demerit points, that tips me 2 points over the limit, so i can either choose to lose my license for 3 months, or go on good behaviour for 12 months.

What would you guys do, court or Bend over like nark said and pay it -- would u take 12 months suspension or 3 months loss?

good question. If you get caught doing anything worng during the 12 months probation your f**ked. if it were me i would take the 3 months get 12 points back and make up for the 3months of having no fun in my car.

INASNT did you have a lawyer? or did u argue urself?

wat happened to you sounds exactly wat happened with me, i only had 1 cop he was a senior sergeant aswell. precedent doesnt apply to magistrates court so ill have to argue my case well.

nismoid how pricey is the lawyer lol, id rather pay $210 and drive normally for 12 months depending on the price

Dam that's a hard one.

Although I've never been in that position, one thing wrong during that 12 months and you're rooted....

12 months is a long long time, and no matter if it's on purpose or accident that you go over the limit or something.... you're rooted.

Opinion: Take the 3 months.

I think if you take it to court there is still a good chance you will get a reduced fine, but even with this reduced fine you may receive 1 dimerit point, which will cancel your licence anyway. You have admitted to us that you know you where in the wrong, but only you know how far in the wrong you were , so ask yourself is this a fair fine.

With regards to probation or loss of licence for 3 months, that is also something you have to ask yourself. Are you able to resist the temptation to speed, run that yellow light, and all the other infringments that will cause you to break the probation, knowing that the next cop to pull you over will check your records and have no hesitation in issuing the fine, due to your previous record. Personally i wouldn't risk it and accept the 3 month loss. Or go on probation and find yourself a shitty car to drive for 12 months and leave the 'line in the garage.

would driving the skyline on p plates be something that would violate probation? in any other case i would've said take the probation if you think you can be good...but if a cop pulls you over for driving a car over the power/weight limit on p's, if that violates your probation, your fked!

Blade, one option you do have is to take a look at your record and determine how long you have before you get points back to save your license if you take the 3 points.

Then, if the period is not much greater than 6 months I'd suggest that you elect to contest the fine, wait for the summons to court (could take almost 6 months) and the appearance date which is usually somewhat later. As the date approaches and you have your points returned you then pay the fine and a small admin fee and you have kept your license.

Of course this is all wasted if you then are caught again in the meantime.

12 months, and you could just accidentally forget to indicate, and bamo - that 3 months is 6.. especially in the revenue state where cops are nazis. I wouldn't risk it down there.

But you do have to take into consideration how it may effect your insurance, etc in future. Then again, I've heard insurance companies these days take licence loss and point loss as less serious, as its so common these days in today's environment..lol

Lawyer at mates rates. Friend of someone that was building my car at the time

Judges wont take you serious if you try defent yourself without a lawyer at the main hearing.

I think this is a fair fine, i was easily doing more then 120. I got caught red handed, and i didnt argue with him. i felt bad, and i think i will take the fine, but it he didnt follow me at all so he made the speed up.

GTRGeoff i like your idea alot, its only 4 months before i get 4 points returned too me, so maybe i can stall it by taking it to the court, then once i get my 4 points back i can pay the fine and cancel the court and pay the small admin fee.

So to double check on p-plates u get ur points returned to you 1 year after the offence? I got caught for driving over but under 15 december last year =1 point, and 1 day after between 15 and 25 = 3 points, only 4 months away till december . Have u done this before geoff or know of someone whos done the same thing?

haha i got that also and i was only 18!! lost my licence for going 32 k's over the speed limit which costed me 4 points, and not displaying rear plates for 3 points which resulted in a 7 point loss that night

right now i have passenger restrictions and i too was given that option of handing in my licence or driving for 12 months on that good behavour thing. im now 19 and i have to be on my best driving behavour till December until i get my points back and i can have more than 1 passenger in my car

if i was u go for the 12 months good driving and drive like a god damn pansey!
