Guys, got caught doing "31 over" in a 80 zone tonight 1am with no traffic.. As i turned right at an intersection there was headlights 200m behind me and i was casually closing in on about 100km/h or so i believe. The vehicle was at all times about 200m or more behind me til i saw it catching up slowly, so i started accelerating again slowly thinking it was cops and was looking for a quick getaway but i was not familiar with the area..

They flash their pretty lights from about 150m away and pull up (paddywagon) with 2 cops walking to my vehicle, breath test me, ask if i have any items in car etc.. They then advised me i was doing 31 over the limit and its automatic loss of license, they then asked me a series of questions and i put on a bit of a story telling him i only have 4 points, the driver then went back to his vehicle and ran my rego, then when he returned he said he considered my story and looked over my vehicle saying it doesn't look hoonish?!? then advised me he is ticketing me at over 15 but not 30. He then started talking to me about the road toll etc, and i advised him last night in the same area they pulled me over a highway patrol vehicle was doing 110 past me in a casual no-lights manner, and he said he receives alot of complaints but they cannot be verified...?

So he then tells me he will send the ticket in a couple weeks so i can start saving to pay for it, (no reference was made to him about my finances) and they departed.

What i am confused about is why wouldn't he write the ticket then and there? You already get 28 days to pay. At no point did he write anything down on paper, and they seemed to be alittle sympathetic due to my acting skills. Also, the ticket is not cheap but not many people need over 4 weeks to pay for it...

Can they send you tickets without documentation/photos?

The question that is killing me is, did i get off with a warning tonight? Did they try to scare me? Help me out guys!

Knowing that i only have 1 point left means driving my car slow is a risk on its own.

Also, it was a paddywagon, are these equipped with radar? I will be appealing this no matter what, but if they got the speed reading from their speedo with 200m distance i surely have a case. They didn't tell me my speed except 31 over, and i was too anxious i forgot to ask any more questions.

Thanks guys for any help this is gonna keep me from sleepin!

Cheers.

well, just on this point....yes they can send you the ticket and not write it "there and then"....I had it happen to me...reason being, he didn't have a ticket book with him.

I recieved it the next day...had no stamp on the envelope either, so i think they "personally" delivered it to my letterbox :)

seems strange that they didn't take any of your details though...did they look at your drivers licence at all? Maybe they just noted your rego and will get all your details from that? That's assuming they asked you if it was your car...

hi well they can send you a ticket but they must send it from there end within 7 days as they have all your info ummm but paddywagons dont have raders in them so basically they are guessing it when you get the ticket(if) see who sent it if it was anyone under the rank of seargent fight it because any 1 under that rand does not have the capibility of juging the speed because they have not been in the job for gong enough

if there are 2 cops in a car, then u can be pulled over by them with them just approximating ur speed by using their spedo. the other coppa will be the witness to the incident, and will therefore verify that speed by also lookin at their speedo.

So yeh good luck mate. but fight it to the courts, then plea not guilty. It'll take u forever to get to courts, hence u will have ages to pay for the fine.

Ok so you have admitted you are guilty and you are still going to contest it? Why? You knew the speed limit yet you went over it and you got caught. Cop it on the chin and move on.

They didn't tell me my speed except 31 over,

Are you serious? 31 over the speed limit of 80km/ph means you were doing 111km/ph.

In affect you should have lost your license then and there. Consider yourself VERY lucky and accept responsibility for your actions.:)

A mate of mine told me a story about him being pulled over doing 125km/h in a 60 zone racing a bike.

The female officer in the unmarked car said she was going to send him a ticket for something like 20 over the limit but it never arrived.

I think this is the same case. It's a cops job to book you for speeding, but if he says he'll do it later and it "slips" his mind, then he can't get busted for it and he's let you off.

Cheers,

Tim

Sounds very suspicious to me. Im sure they must legally write the ticket there and then (someone want to verify this??). Actually i'll ask all my cop friends.

My ex-gfs sister is a highway patrol and she -always- said to ask the officer to -see- the speed you were clocked at (as in physically get out and look in their car), they have to let you. She then went on to explain that 50% are exactly like the case above "ahh we caught you doing blah speed here's your ticket" when infact they didnt at all.

I've only been pulled over once, i think it was about 58ish in a 50 zone (absolutely stupid road for a 50 zone) i was following 2 other cars and im sure if i continued driving and someone else stopped they woulda just got that car instead as their is no 'proof' as to whom of the 3 cars they actually clocked. I copped it clean and moved along as i was on my way to a club.

Edit: I'd really like to get a book or something on our rights on the road for things like this. I'd really to show up a Copper on his own job.

Yes he certainly may be using scare tactics, but remember the important fact. He wasn't a prick about it. The fact that he didn't hit the roof and blow a nut says to me that he sort of understood where you were coming from. How many horror stories and bad rumours about the cops are going about, people need to recognise that coppers aren't all bad (most of them anyway).

I would cop this one, taking it to court may be great if you win, but sometimes the consequences aren't so good.

Oh and I have had my fair share of fu(king arsehole cops, don't think I love them or anything, but you need to recognise when someone has done you a favour.

hopefully you got away without a ticket since you have 1 point, but you should have asked for them to show you the radar showing that you were doing 31 over, if they didnt have a radar then you could have told them that you were doin 10 kays over or sumthn, but since there was two of em then you cant lie too much, but i dont think they had a radar since it was a paddy wagon, only the highway patrol cars have one fitted on the car...i think.i think that they gave you the 15kays and over fine cause they didnt have proof that you were doin 31 and over....it was probably a guess for them.

oh well, i guess you will see in a couple of weeks if you got the fine or not,

drive safely mate.

Yeh I have never seen a paddy wagon with the radar either.... I seriously think you just got the scare tactic because they would have written it on the spot but they probably couldnt be bothered writing out the fine or were just understanding seeing as u were nice to them....

Make sure u write back to let us know whats happening!

Just for the record, I've been pulled over (wasn't for speeding, was for *apparantly* passing a stopped tram) - and my ticket arrived by mail. The policeman (very friendly and respectful) didn't know the exact name of the infrindgement.

If you know you were guilty, don't worry about it - I'd just pay the fine and move on . I contested mine - received a summons to go to court, then withdrew my objection and now I'll just be paying it. All of that extra stress etc, you just don't need it :hippy:!

Also, its your word against theirs. Do what I did and don't bother wasting tax payers money and peoples time going to court knowing that you did do whatever it was.

For those like me that truly question whether you deserved the ticket - think of all those other times you have sped, copied games, taped TV!, drank underage, done burnouts, etc etc and haven't been caught. Sure I was a bit of a pushover in not going through with the objection, but I think I'm still ahead just a bit! :jester:

just pay it man... the cop wasnt a prick to u and instead of u losing ur license u got a fine... now ur going to take him (as he will have to show up to the case as hes the one who ticketed u) to court and ur going to basically dispute him for doing his job.

u know what will happen after that.... he will never let anyone off as lightly ever again and will turn into the same as all those other cops.
