My R33 Skyline Is Smashed

I was involved in a small accident, A non Turbo Black Nissan R33 was driving Down canterbury Road in Bayswater north, It over took my self and then over took a Blue VY Commodore, it pulled infront of the blue Commo at around 100kmh, we continued heading down canterbury road and the Blue Commo was in front of me and the Black R33 was infront of the Blue Commo, The Commodore and the Black Nissan kind of pulled away from me, as I was about to cross a set of lights the Black R33 came to a sudden STOP, Smoke went everywhere, I see the Blue Commodore Slammmm his Brakes on and then I slam my foot down on mine, It was to late i hit the Blue Commodore :P I get out of the car to see my Baby all smashed up :) The blue Commo was not to bad, the damage was not to bad at all, and the black R33 had a little damage but nothing to bad, I look at mine and it was pretty messed up :) The Bonnet was all pushed up, the front bar was destroyed and the head lights and R-H Front Guard was all pushed in, It's going to cost around $6,000 to repair my car :angry: I ask the driver of the Black R33 what happend and he said that the Diff Blow up, they had just replaced it like 1 hour before the accident, they had just brought the black R33 like 1 week before hand, I think they did not put OIL in the diff but I'm not sure. The owner of the black R33 said he takes full responsibility for the accident and that he as very sorry, I got all his details ect....... I have spoken to him a few times and yeah, I think it looks like I will be an old man before I see a cent, I'm not sure what to do. I am going to start to repair of my Skyline for I already miss it like crazy, I have brought an after market Front bar for series 2 and a series 2 bonnet, Umm does anyone know if I will there is a difference in guards between the series 1 - and - 2? and I'm having trouble getting series 2 head lights, Any Ideas? I don't now what the law is over there but in NZ it is ALWAYS the fault of the driver of the car rear-ends another vehicle because they have not allowed enough braking distance.

He may be reluctant to pay out if he now realises that legally he doesn't have to.

that black 33 didn't happen to be a supercharged non-turbo 33?

i heard a dude had bought it then blew the diff like a day later... now this

btw- yep series 1 guards are the same and will be fine with the series 2 lights/bonnet

I cant believe the guy admitted fault! Does he have insurance? If so, just go through them and they will pay you out relatively quickly.

Insurance companies dont like it when you admit fault to an accident, it says in their handbooks NEVER to do it.

this is true...

If he admitted that his diff died and that caused him to hit the brakes then thats all there is to it.

however if he didnt the usual way it works is you generally have to pay for the person whos arse u rammed. so in this case the commos at fault to the black 33 and ur at fault for the commo etc

you were too close its your fault

regardless of reason for breaking if he braked and his brake lights worked then its your fault. its all part of travelling too cloose. youve got no chance. it will be your fault sorry. no matter what you should keep safe distance to allow for emergency stop

best thing to do at any scene of an accident is to write a statement yourself.. and get involved parties to sign...

this way.. no one can ever go back on anything.... esp. when they dont can sleep over what happen.. the stories seem to change the following day....

this keeps the insurance company extremely easy to deal with.. esp. if u have 3rd party insurance..... ull find they suddenly turn from being no help... to very helpful...

That's a good idea, always try to get everything in writing!

Although I have heard of cases where the insurance company says that the driver at fault wasn't in a position to admit fault and therefore they won't pay. Such a load of crap!

Sorry to hear about the crash. Good luck getting it fixed.

and good luck trying to prove it when you run up the butt of someone with no working brake lights (I've come close to doing that myself!)

as far as im aware proving the brake lights weren’t working isn’t as hard as it sounds... if insurance are dealing with the situation the broken globe will break in a different way to what it would if it was working something to do with the elements being lit and not lit.. So it's possible just depends how much mucking around you want to be doing....

Insurance companies are like lawyers and can twist words around to help themselves.

Get a stat dec signed by yourself and the other 2 drivers if possible stating what happened and who is admitting fault and get a cop sign it also. It may be the only way his insurance company dont tell you to get stuffed.

Doing 100km/h do dont expect the person infront of you to suddenly just slam on the brakes for no reason if there is no obstruction in front of them no matter how much space you keep between your 2 cars

its besides the point what you expect. as paul said, the driver behind is at fault, regardless of the other guys diff. his diff blew, so he stopped in an emergency situation....you're too close, you hit him. too bad.

and as mavric stated, they can tell if the brake lights were lit up at the time they were smashed

Yes it was supercharged, and he did not actually brake at all, he had no brake lights, something happened to the diff and the wheels stopped turning, it siezed it the wheels just locked up, he did not brake at all, and ther was so much smoke I could not see the brake lights of the Blue Comoodore, I accept the fact that it is nearly always the rear car to blame but yeah, this is pretty shit for I now have to fix the commo, It is covered bye 3rd party, and I need to try hard to get mine fixed asap,
