Hi guys,

I got pulled up again last night, this time by an officer from the traffic branch.

Now get this, my car has got a bigger then standard exhaust muffler on it, just your average sports ones that you can get at any muffler shop or auto shop.

The officer walked up to me and said I’m writing you out a tick for you exhaust. I said why, He said because it’s not standard.

I said it doesn’t have to be standard to my knowledge as long as it complies with Emissions test, which is only a noise db reading, which is 91db from memory and the car does infact meet those standards. Has been tested many times.

And he said it has to meet the stock db reading of 80 somthing db, And i must have the stock exhaust on it not a larger one.

So he started writing me a ticket out for the following:

"Driving Vehicle with reduced effectiveness of silencing device"

That is what it states on the ticket, can any one elaborate some more if it’s illegal to have a bigger muffler on your car? And if this fine is just a load of crap?

And just for the record my car is a stock r33 GTS-T with your basic mods, Exhaust and pod.

That's a big load of crap from the POW-LICE.

it doesn't really matter if you have a large muffler as long as the DB reading for a car that was made from 85 ( not sure ) onwards would need to have a db reading of 92 or less.

unless this pig run a test down on your exhause and producing more than 92db..?

best thing u can do is to take it down to an exhause shop who can print out a reading on your exhause db level and take 'em to them.

I dont want to influence your case by saying any of this.

I was pulled up once and the cop was just a foolish man. I know he didnt have his sound recorder on because of the way he was speaking to me.

ANYWAY... He was going around and around my car trying to defect me. He started with my tyres, but said nothing then finally got to my exhaust, which was an entire 3" system I got with the car. He said that it was too big. When he said too big that could of meant a few things..... very broad. He then said its too loud, too big.. bigger than factory. My only reply was, I have a safety and compliance certificate for it. From what I saw, maybe because of his foolishness, he had no foot to stand on with my reply. NOW some officers may have done something different and booked me. But this officers then said told me to respect the police and go home and fix my exhaust????? WTF. Signs of loss.?

I haven't really answered your question but given you some ideas about what I did when they said that stuff to me. They could of had a measuring device in their car, it could be illegal.

I have a normal aftermarket exhaust that was complied and safety certified. That is all I stand on.

You said that the police officer said your exhaust was not standard. Then he wrote you a ticket for not having a good enough silencing device. I would question that to define what a silencing device is mate.

Exactly, He didn't have a measuring device on him and he didn't say that my exhaust was too loud, I have since contacted dep of transport and they have said, As long as your car meets the ADR which is 90db it doesn’t matter what size exhaust you have. They said it DOES NOT HAVE TO MEET FACTORY DB READING.

We are in australia not JAPAN !!

As your factory exhausts burn out after time and on a jap import car you can't get a genuine exhaust system easily.

So basically I have the test results all ready from previous testing and said that to the officer that my car has past many times, But he still issued me the ticket.

Sounds like a legal case to me :(

This really boils my blood.

Take it to QLD Transport or a Engineer and get it done. then the next time this f#ing clown pulls you over or any other small penis, mummy spanked me officer pulls you over its in balck and white. The next thing you ask for is his full name, badge number, Station, superior officer. Then lodge a formal complaint, include your engineers certificate, with a polite letter with a please explain.

I had some tool constantly try and book me on my way home, the loser is now pushing papers for 6 months on desk duty.

I was actually talking to a barrister the other day, and he is of the same opinion as me, you make it legal, then use that power to reduce their's, which is only based on non-wrriten subjective assessment, which in a court at common law holds minimal water!!!

I have been told that the legislation the the QLD police rule under states that anything that is not stock or a factory option can be considered a defect. Yet the QLD Dept of Transport rule under a different set of legislation, meanwhile you have a bullsh*t fine for nothing.

Asking them to get thier supervisor down is also fun. They dont like that much.

But I gotta say, I really never get pulled over. You sure you lot arent doing something wrong? Like eating a baby or something at the time?

Doing something wrong, How about getting pulled up while washing your car !!! At a car wash.

Mate i feel your pain. We've just been put over the pits because of absolute crap that the cop made up... atmospheric bov (passed), fmic (passed), steering wheel (passed). BUT.. department of transport DO NOT test emissions or noise. I know this because they have said that i need to get that done myself (and pay for it) and send them the results.

I would fight the ticket when your results come back as fine. and also send them a letter and a bill for the days pay that you lost and the cost of the test. I know I am.

Car wash one is harsh. You cant even TRY to run away and hide.

Serious, ask them to get thier supervising officer down there next time, because you dont like thier additude or something. That wakes them up a lot.

You got some good ideas from the community here, I would personally take it further and sort some legal avenues. Its prolly a small fine you got, but man if it puts the dick head behind a table pushing pens, that protects the whole car enthused community from assholes like him. Excuse my language kiddies. Of course the police officers friends might not like you. But hey, dick heads tend to associate in clusters. Dont take this as all of them, there are some very level headed officers out there who know the difference between a stock intercooler on a GTR and an aftermarket cooler on a gtst.

Write down on paper all that was said, date and sign it. If you have a witness get them to sign it too.

last time i asked for senior sargents name they defected me even more.. they didnt like it when i asked them ... my polite mouth got me a 150 defect ticket and 4 points....(pod,zorst,fmic,too low).. But on the other hand i did win the case in court.

I just cleared my defect, the inspection station at darra does do db testing to compy with ADR rules, at least they said so when i asked them..

If anyone gets done for a MOMO wheel like i did pm me and i can give a copy of a letter from an engineer that speaks for roman autotek (aussie importer of momo) that says momo wheels are legal, saved me hundreds because i thought i was going to be forced to buy a new one...

Defects suck, i got pulled over on a sunday morning, by myself, driving at 50kph.. Its cost me over $800 and f**k knows how much running around before hopefully i'm clear of it (sent the final paperwork in a couple of days ago)

While i was at the QT inspection station they asked me "mate you shoud get a copy of our pamphlet on modifications", to which i replied "i already do, but funny thing it doesn't mention anything about pod filters and bov's, one of the most common mods you can do,whys that???" they didn't like that... :lol:

hi mate, i'm the guy who spotted you pulled over and then got pulled over by the same cop a week later. bov's are tied up with the rule on noise and emissions apparently. when they went over my car all they asked me was 'does it have a tune?'. i assume he meant a whistle or something, which it doesn't. (and i have an atmospheric bov). but the logan inspection station doesn't test for noise or emissions so i have to get that done myself. do you know of anyone who does?

No idea, but i've heard emissions testing can be expensive.. just do what i did and fit up a blocking plate where the bov sits to clear the defect, then refit it again afterwards if you wanted. No point arguing with them because its not worth it..

My inspection was pretty thorough, the guy at darra even ripped open my boot trim looking for "nos gear" :)

The plan of attack is to get a current DB check on my car, which is booked in this week.

Then take in the information to Senior Sgt of the Traffic Branch, and if they don't do something about the ticket, I will defiantly take legal action, as it sounds like that’s the only way things will happen.

As this is just becoming harassment, to import owners and we need do something about it!
