Unsigned Infringement Notice

Recommended Posts

Just recieved a fine today (the day before christmas ;) ) for unroadworthy tires. That's not the issue, my question is are they (the fines) still valid if they are not signed by the issuing officer (or any officer in my case)? Not trying to get out of it cause they are actually unroadworthy (haven't checked them in a while) but could he have given me a christmas present by not having to pay for it.

hey mate, try PM'ing Johnny Cash...he's a law student, or a lawyer even...and seems to know his stuff....he has a thread going at the moment with police powers and our rights, so he'd almost certainly be able to help you out.

hey,

can i get a link to that thread?

Well, for the fine to be official, it would have to be signed by the issuing officer. But in the case where they forget to, they could simply re-issue another notice with the correction. Unfortunately, you would not be able to refuse paying the fine because of a failure on the issuing officer's part to sign it. :(

Sorry for the bad news, especially at this (otherwise) festive time of year. Bad things happen to good people, and providing the fine isn't too expensive, it might be worth saving the hassle of arguing such a technicality.

The reality is, it's an administrative error, rather than an error in law, and would be quickly resolved. So, for what it's worth, you could refuse to pay it based on it not being signed, but then they would simply re-issue a notice that IS signed, and you'd have to pay it anyway. Might as well get it out of the way...

As I said in my disclaimer from the original thread, I don't guarantee ANY of this information, because I don't want to get sued if anyone relies on it to their detriment. But seeing as it's free of charge, you're welcome to it. :)

    • Yeah. "New pump" does not have to mean "massive pump".
    • Well, can you still get an OEM pump, and by the time you're buying a Nismo/N1 etc, just buy another aftermarket pump. It's better to have the pump able to flow more if its needed, than for your pressure to drop off. At any point in time, you're replacing the oil pump in a rebuild. Aftermarket pumps are likely going to be a better economical choice, and they don't have any negatives, even if they can flow more.   Also, when you're saying "replace the pump gears" are you meaning leave a 25+ year old housing in the engine with unknown wear, and just put new gears in? As that sounds silly to me, especially if you do have that minute amount of wear, that means your new pump gears now have a little bit more clearance beside them, which means, whelp, you may not get to build a lot of oil pressure or make a lot of flow.
    • Right, but if you replace the pump gears + put a spline or sine drive gear on the crank on a Nismo/OEM/N1/etc pump at that point do you really still want more flow/oil pressure? Let's say this is a the aforementioned "keep it simple" build, no more than ~400 kW at the crank.
    • Strength. And on the early RB26, full engagement of the pump drive.
    • I really don't understand the point of aftermarket oil pumps if your particular engine doesn't need more oil pressure. As far as I can make sense of it the problem seems to be cavitation from sucking air, maybe the pump gear design with how it interfaces with the OEM crank, and maybe the backing plate screws wanting to loosen themselves. How does flowing more oil fix these issues?
